If you have created a product with a unique appearance (such as the shape, pattern, or ornamentation) you may be able to protect it through registered design rights in Ireland.
To register a design, you must file an application with the Intellectual Property Office of Ireland (IPOI). In order to be registered and afforded protection, your design must be new and have individual character, meaning it should not be identical or similar to existing registered designs.
If successful, registration will give the designer the exclusive right to use the design and to prevent others from using it without your permission. Once registered, design protection in Ireland lasts for 5 years, and it can be renewed in 5-year blocks for up to 25 years total.
In Summary:
- File your design registration with the IPOI.
- The design must be new and distinctive.
- Protection lasts up to maximum of 25 years, with renewals every 5 years.
