AI Creates It – But Who Owns It? Understanding AI and Intellectual Property Rights
AI Is Changing Intellectual Property
The rapid growth of artificial intelligence (“AI”) has created new uncertainty around intellectual property ownership. Where AI tools generate text, images, code, or designs, it is often unclear whether copyright can subsist in the output and, if so, who the rightful owner is.
Why Ownership of AI-Generated Content Matters
Internationally, approaches to this issue remain inconsistent. Within the European Union, the prevailing position remains that copyright protection is tied to “the author’s own intellectual creation” which continues to imply a requirement for meaningful human creative input. As a result, AI-generated content currently sits in a fragmented legal landscape, with significant variation between jurisdictions and no universally accepted global standard.
Practical Considerations for Businesses Using AI
This raises practical issues for businesses using AI in marketing, branding, and product development. Without clear contractual terms or internal policies, disputes may arise over ownership of outputs and the use of training data. Businesses should therefore carefully consider how AI tools are integrated into workflows and ensure appropriate legal safeguards are in place.
